1. Agreement to these terms
Dispry (“Dispry,” “we,” “us”) provides software that lets you display images, video and slideshows on televisions you connect to it. By creating an account or using Dispry, you agree to these Terms of Service. If you don’t agree, please don’t use the service.
2. What Dispry does
Dispry turns a TV into a display you control from your phone or computer. You install our app on a compatible streaming device or TV, pair it to your account with a code, and upload content to show on that screen. Dispry delivers your content to the screens you’ve paired and keeps them in sync.
3. Eligibility and accounts
You must be at least 18 years old, or the age of majority where you live, and able to form a binding contract. You’re responsible for keeping your login credentials secure and for all activity under your account. Provide accurate information and keep it current. You can delete your account at any time from the Account page.
4. Your content
You keep all rights to the images, video and other content you upload (“Your Content”). You grant Dispry a limited license to store, process and display Your Content solely to operate the service for you — for example, to deliver it to the screens you choose. You are responsible for Your Content and for having the rights to use and display it, including any logos, photos, music or trademarks it contains.
5. Acceptable use
Don’t use Dispry to display or distribute content that is unlawful, infringing, deceptive, hateful, harassing, or that violates anyone’s privacy or intellectual-property rights. Don’t attempt to break, overload, reverse-engineer, or gain unauthorized access to the service, and don’t use it to display content to the public that you don’t have the right to show. We may suspend or terminate accounts that violate these terms.
6. Plans, free tier and billing
The Free plan covers one screen at one location with the features described on our Pricing page. Paid plans add more screens, locations and features. We’ll clearly present a plan’s price and terms before you’re ever charged, and no payment is taken without your consent. Features and plan limits may change as the product evolves.
7. Devices, networks and third-party services
Dispry runs on third-party hardware (such as streaming devices and televisions) and app stores (such as Google Play and the Amazon Appstore), and depends on your internet connection. Those devices, stores and networks are outside our control and subject to their own terms. You’re responsible for providing and maintaining the hardware and connectivity your screens need.
8. Availability and changes
We work to keep the service and your screens online, but we don’t guarantee uninterrupted or error-free operation. We may update, add, or remove features, and we may modify or discontinue parts of the service. If the internet drops, a paired screen is designed to keep showing its last content until it reconnects.
9. Intellectual property
The Dispry software, apps, website, branding and content we provide are owned by Dispry and protected by intellectual-property laws. These terms don’t grant you any right to our name, logos or software except the limited right to use the service as intended.
10. Termination
You may stop using Dispry and delete your account at any time. We may suspend or terminate access if you violate these terms or use the service in a way that could harm Dispry, other users, or third parties. On termination, your right to use the service ends; sections that by their nature should survive (such as content ownership, disclaimers and limitations of liability) will survive.
11. Disclaimers
The service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose, availability, or that content will display without interruption or error. You use the service at your own risk.
12. Limitation of liability
To the fullest extent permitted by law, Dispry will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of (or inability to use) the service. Our total liability for any claim relating to the service is limited to the amount you paid us for the service in the three months before the claim, or, if you’re on the Free plan, is limited to US $50.
13. Your responsibility for what you display
You are solely responsible for the accuracy and appropriateness of what appears on your screens — including prices, menus, announcements and any other information. Dispry isn’t responsible for business decisions made based on content you display.
14. Changes to these terms
We may update these terms from time to time. If we make material changes, we’ll update the “last updated” date above and, where appropriate, notify you. Continuing to use Dispry after changes take effect means you accept the updated terms.
15. Governing law
These terms are governed by the laws applicable where Dispry is operated, without regard to conflict-of-laws rules. Any disputes will be handled in the courts with jurisdiction over that location, unless applicable law requires otherwise.
